The main issue that I have personally noticed with the animal cruelty cases that I have been involved with is not whether there are significant levels of punishment but whether anyone will bother to take the time to either enforce the statutes or prosecute the offenders. My worst example is a case that I am directly involved with - 100+ animals, the majority being reptiles taken from a reptile specialty store. 20 or 30 more dead in tanks or in a freezer in back. We were told that we had to leave SOME living animals behind by local police. 7 or 8 more animals die after they have been removed from the store. EVERY animal was diagnosed with either an undetermined parasitic infection, a bacterial infection, or dehydration/starvation and nearly every animal was infested with mites. The offender gets a total of 7 counts of misdemeanor cruelty - "one for every classification of animal." The case is now 9 months old and arguments are STILL being heard as to whether the offender is legally required to pay restitution despite the fact that precedent has been set at Superior Court level determining that rescues are considered "victims" in cases and are due restitution regardless of the offender's ability to pay.
